Terms of service

These terms govern your use of the Tennis Mates platform (“the service”) operated at tennismates.com.au. By signing up for an account or continuing to use the service on behalf of a tennis club or league, you agree to these terms on that organisation’s behalf and warrant that you have authority to do so.
1. The service
Tennis Mates provides a hosted website and communication platform for tennis clubs and leagues. Each subscriber (“you”, “the tenant”) receives their own branded subdomain, an admin portal, and tooling to publish court availability, outages and announcements and to notify members by email and browser push. We may update, add, or remove features from time to time; where a change materially reduces functionality you depend on, we’ll give reasonable advance notice.
2. Your account
- You must provide accurate, current information when signing up and keep it up to date.
- You’re responsible for the security of your credentials and for everything done through your account. Use a strong password, don’t share your login, and tell us immediately if you suspect unauthorised access.
- The person who signs up is the “owner” of the tenant. They may grant admin access to others, but the owner remains responsible for the account and its billing.
3. Acceptable use
You agree not to:
- Use the service for anything unlawful, deceptive, infringing, defamatory, harassing, or that violates another person’s rights.
- Interfere with, disrupt, or attempt to gain unauthorised access to any part of the service, other tenants’ data, or our infrastructure.
- Send bulk unsolicited email through the service, or use it to send content unrelated to your club’s normal operations.
- Reverse-engineer, scrape, or reproduce the service for a competitive product.
We may suspend or terminate access if we reasonably believe you have materially breached this section; where practical we’ll give you a chance to cure first.
4. Subscription, billing & trial
- Free trial. New tenants get a 14-day free trial from signup. During the trial you can use the service as normal; your card is not charged until the trial ends. You can cancel any time during the trial without being charged.
- Per-club pricing. You choose a club count at signup. That count is your subscription quantity, charged at the listed per-club rate shown on the pricing page (billed monthly in advance through Stripe). The price per club may change with at least 30 days’ notice; changes apply at the start of your next billing period.
- Upgrading. You can increase the club count at any time from the Stripe Billing Portal. Extra charges are prorated and added to your next invoice.
- Downgrading. You can decrease the club count at any time, provided the new count is at least as high as the number of active clubs you currently run. A proration credit is applied to your next invoice. Cash refunds are handled case-by-case by emailing support@tennismates.com.au.
- Going over your quota. Attempting to create more clubs than your subscription covers will be blocked until you increase the quantity in the Billing Portal. An over-quota banner will also appear in the admin portal until you resolve it.
- Failed payments. If a payment fails, Stripe will retry on its normal schedule. If after a reasonable retry period (typically up to 21 days) payment is still not received, we may suspend access until the balance is settled.
5. Cancellation & termination
You can cancel your subscription at any time from the Stripe Billing Portal. Cancellation stops billing at the end of the current paid period; you retain access until that period ends. Your tenant data (admin accounts, content, subscribers) is retained for 90 days after cancellation so you can reactivate without losing anything, then purged. We may terminate or suspend your account for material breach of these terms, non-payment, or if continuing to provide the service would be unlawful.
6. Your content
You retain ownership of anything you publish through Tennis Mates (announcements, images, descriptions, member records, subscriber lists, etc.). You grant us a limited, non-exclusive licence to host, display, transmit and back up that content solely to operate the service for you. You warrant that you have the right to publish the content you upload and that it doesn’t infringe anyone’s rights.
On cancellation or on request, you can export your club’s data via the admin portal or by contacting support.
7. Our intellectual property
Tennis Mates, the Tennis Mates name and logo, and the software behind the service are owned by us. These terms don’t grant you any rights in our branding or source code beyond the right to use the service as intended.
8. Availability
We aim for high availability but don’t promise uninterrupted service. We perform routine maintenance and deploy updates, and will schedule disruptive work outside peak hours where practical. We are not liable for downtime caused by factors outside our reasonable control (including AWS or Stripe outages, force majeure events, or your own network).
9. Warranties & consumer law
Except as expressly stated, the service is provided “as is” and “as available”. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (ACL) that cannot lawfully be excluded. Where we are permitted to limit liability for a breach of a non-excludable guarantee, our liability is limited, at our option, to supplying the service again or refunding the amount paid for the affected billing period.
10. Limitation of liability
To the maximum extent permitted by law, neither party is liable to the other for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, goodwill or data. Our total aggregate liability to you for any claim arising out of or in connection with these terms is capped at the amount you actually paid to us for the service in the twelve (12) months immediately before the event giving rise to the claim.
11. Indemnity
You agree to indemnify us against third-party claims to the extent they arise from (a) content you publish through the service, or (b) your use of the service in breach of these terms, except to the extent the claim is caused by our own negligence or wrongful act.
12. Changes to these terms
We may update these terms from time to time. If a change is material, we’ll give you at least 30 days’ notice by email and by updating this page. Continued use of the service after the change takes effect constitutes acceptance. If you don’t agree with the change, you may cancel before it takes effect.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of that state and of the Commonwealth of Australia sitting in that state.
